English: Notice of Application for Environmental Authorisation, Atmospheric Emissions License – (B)

Notice is hereby given in terms of Regulation 41(2) published in Government Notice No. 982 under Chapter 6 of the National Environmental Management Act 107 of 1998 (NEMA) Environmental Impact Assessment (EIA) Regulations (2014, as amended) of Zululand Energy Terminal (Pty) Ltd (ZET) (the Applicant) intention to submit an application for Environmental Authorisation (EA) to the KwaZulu-Natal Department of Economic Development, Tourism and Environmental Affairs (EDTEA).

Notice is also given in terms of:

  • Section 38(3)(b) of the National Environmental Management: Air Quality Act 39 of 2004 (NEM:AQA) for an application for an Atmospheric Emission Licence (AEL).
  • Section 69 of the National Environmental Management: Integrated Coastal Management Act 25 of 2008 ICMA) for an application for a Coastal Waters Discharge Permit (CWDP).
  • Section 21 of the National Water Act 36 of 1998 (NWA).

Applicant, Activities and Location:

Zululand Energy Terminal (Pty) Ltd (ZET) proposes to construct a Liquefied Natural Gas (LNG) terminal located in the South Dunes Precinct at the Port of Richards Bay, KwaZulu-Natal. The terminal will utilize new marine infrastructure to accommodate a Floating Storage Unit (FSU) and will feature an Onshore Regasification and Storage Facility, jetty-to-shore interconnecting cryogenic lines, and a seawater abstraction and discharge system for heat exchange. Additionally, the project includes a regasified LNG (RLNG) pipeline, a new gas distribution hub, truck loading facilities, and bulk services.

NEMA Listed Activities: A Scoping and EIA process is triggered by at least the following listed activities:

Listing Notice 1:  Activities – 12, 15, 17, 19 and 19A.
Listing Notice 2: Activities: 2, 4, 6, 7, 14 and 15.
Listing Notice 3: Activities 12 and 14.

NEM:AQA: In terms of Listed Activities (Section 21 of NEM:AQA) Sub-category 1.2: Liquid Fuel Combustion Installations and Sub-category 1.4: Gas Combustion Installations are applicable.

Competent Authorities (CAs):

The CA for the EA application is KZN EDTEA, for the Atmospheric Emissions License (AEL) is King Cetshwayo District Municipality (KCDM) and Coastal Waters Discharge Permit (CWDP) is the Department of Forestry, Fisheries and the Environment (DFFE). The CA for the Water Use License (WUL) is the Department of Water and Sanitation (DWS). CES has been appointed by ZET to undertake the Scoping and EIA process in terms of NEMA EIA Regulations, AEL, CWDP and WUL applications.
