Notice is hereby given in terms of Regulation 41(2) of the National Environmental Management Act 107 of 1998 (NEMA) Environmental Impact Assessment (EIA) Regulations, 2014 (as amended) of the resubmission of an application to the Provincial KZN Department of Economic Development, Tourism and Environmental Affairs (EDTEA) for Environmental Authorisation (EA). Notice is also given in terms of Section 41(4) of the National Water Act 36 of 1998 (NWA) for the submission of an application to the Department of Water and Sanitation (DWS) for Water Use Authorisation.
Proponent, Activities and Location:
Zululand Energy Terminal (Pty) Ltd is proposing to develop a new natural gas transmission pipeline with an 80 barg design pressure and 24 inch diameter from the RBIDZ gas hub to the Empangeni Lilly gas station within the City of uMhlathuze, KwaZulu-Natal Province. The pipeline is anticipated to be buried at a depth of 1 to 1.5 meters (to top of pipe), depending on the location and safety considerations. The pipeline will also include isolation valves at key crossing points and interfaces. The pipeline will have an in-line inspection and cleaning system for periodic inspections. A high integrity pressure protection system (HIPPS) will be used to protect the pipeline from over pressurization. During construction a 30 m servitude will be required and thereafter a 6 m operations and maintenance servitude will be required. Liquefied Natural Gas (LNG) has been identified in the National Development Plan as a priority source of energy to aid in alleviating South Africa’s energy crisis. The development of the LNG connection from the RBIDZ gas hub to the Lilly gas station will allow LNG to be supplied to inland gas-reliant industries. The LNG pipeline falls within a “Strategic Gas Pipeline Corridor – Phase 7: Coega to Richards Bay for the Development of Strategic Gas Transmission Pipeline Infrastructure” as identified in GN 143 of 26 February 2021, and based on GN 411 of 7 May 2021, the applicant will follow a Basic Assessment process.

Competent Authority:
The competent authority for the Environmental Authorisation is the EDTEA while the competent authority for the Water Use License is the DWS. CES has been appointed by Zululand Energy Terminal (Pty) Ltd to undertake the Basic Assessment and the Water Use Authorisation processes in terms of the NEMA EIA Regulations, 2014 and the NWA respectively.
